Refugee & Asylum

An individual can get asylum in Canada as a refugee, provided there is a risk to his/her life in the home country or fears of persecution based on various factors like race, caste, nationality, etc.

 

The Refugee and Asylum protection have two different programs.

 

The In-Canada Asylum Program

 

  • This program is for individuals making refugee protection claims from within Canada.
  • Under this program, the individual can apply for refugee status at two places – point of entry to Canada (land border, airport, seaport) or designated CIC (Citizenship and Immigration) centers.
  • In the application process, the refugee claimant needs to provide information about their family, background, and valid reasons why he/she is looking for refugee protection in Canada.
  • If the claimant is found to be eligible, he/she would be required to attend a meeting with 
  • Immigration and Refugee Board of Canada (IRB).
  • If the board finds the claim genuine, refugee protection is granted.
  • The IRB hears refugee claims within 60 days of application.

 

The Refugee and Humanitarian Resettlement Program

 

  • This program aims to provide protection to individuals who are outside Canada.
  • Through this program, refugees who stay overseas can resettle in Canada and start their life all over again.
  • The reason for resettlement in Canada through this program may be severe hardships or atrocities faced in their home country.
  • Not every individual is eligible to come to Canada and resettle from a foreign country.
  • An individual cannot directly apply to the Canadian authorities under the Refugee and Humanitarian Resettlement Program.
  • For an individual to apply, he/she requires:

 

Sponsorship from the United Nations High Commissioner for Refugees (UNHCR) or any other organization.

 

Sponsorship from private sponsors or sponsor groups.
